Terms and Conditions (Designs Kingdom)

Introduction: These Terms and Conditions govern all services provided by Designs Kingdom ("we", "us", or "our"), a digital agency based in Birmingham, UK. By engaging our services or using our website, you agree to these terms.

1. Definitions

Client: The individual or business commissioning our services.
Services: Logo design, branding, web design and development, app development, SEO, social media marketing, motion graphics, content writing, and any other services we offer.
Project: Any specific work agreed upon in a quote or proposal.

2. Quotes and Contracts

All quotes are valid for 30 days unless stated otherwise. A contract is formed when you accept a quote in writing (email is sufficient). We reserve the right to adjust pricing for significant changes in scope.

3. Payment Terms

A 50% deposit is required to start most projects. The remaining balance is due upon project completion and before final files are released. For ongoing services (SEO, social media management), monthly payments apply in advance. Late payments may incur interest at 8% above the Bank of England base rate.

4. Revision Policy

We provide revisions depending upon the package you selected. Customers can request free revisions provided that the design and concept remain the same as per the original brief. Additional revisions beyond the included package amount will be charged at our standard hourly rate. Revision Turnaround Time is typically 48 to 72 hours depending on complexity.

5. Refund Policy

Deposited funds are non-refundable once work has started or if initial design concepts are approved. Refund requests are handled as follows:

Full Refund (minus 10% service fee) is available if requested before any design work has commenced.
If a refund is requested within 48 hours of initial delivery, eligibility will be discussed based on project status.
No refunds are provided once final files are delivered or once a website is deployed and live.
A refund request must have a valid reason qualified against the original design brief. Further revisions are always offered as the primary solution.
Projects with no activity for more than 60 days will be deactivated. Re-activation requires a fee (50% of project amount plus handling fees).

6. Intellectual Property & Ownership

Upon full payment, you receive full ownership and commercial rights to the final deliverables (logos, websites, apps, etc.). We retain the right to display the work in our portfolio and marketing materials. Source files are provided only if specified in your package or agreed upon in writing for an additional fee.

7. Delivery and Timelines

All customized design orders are typically delivered via e-mail/Account Area within 5 to 7 days. We offer a RUSH DELIVERY service (48-hour turnaround) for an additional fee. We are not responsible for delays caused by a lack of Client feedback.

8. Liability

Our total liability is limited to the total fees paid for the specific project. We are not liable for any indirect or consequential losses. The Client is responsible for ensuring that all content provided (images, text, etc.) does not infringe on third-party rights.

9. SMS and Email Communication Policy

By providing your contact details, you consent to receive project updates, revisions, and transitional messages from Designs Kingdom. Standard messaging rates may apply.

Opt-Out: You may reply "STOP" to any SMS or click "Unsubscribe" in any email to cease communications immediately.

10. Governing Law

The laws of England and Wales govern these Terms and Conditions. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
